Tyler has practiced his entire legal career at Broening Oberg Woods & Wilson, beginning as an Associate in 2006, and rising to a Partner in 2012.  Throughout his career, he has enjoyed defending the full spectrum of insurance liability matters from initial evaluation to successful trial outcome.  His current litigation focus is bad faith, professional liability, commercial liability, and coverage analysis.

Tyler’s strengths as a strategic thinker and a persuasive writer and speaker are evident throughout his work.  He has achieved excellent outcomes for his clients in every area of litigation, from securing defense verdicts for national insurers sued for bad faith or products liability, to winning the dismissal of enterprises involved in commercial disputes, to defeating professional liability claims on summary judgment.

Tyler is an Arizona native.  He graduated from Georgetown University in 2000, cum laude, with a Bachelor’s Degree in English (Writing) and Government.  He returned to Arizona for law school at the University of Arizona, where he also graduated cum laude.  

Tyler is honored to have served as Chairman of the Board for The New Foundation, a behavioral health campus that serves youths aged 11-17 and their families.  Currently, Tyler is a board member for A New Leaf, which provides a broad spectrum of support services to families and individuals in need.  A New Leaf is proud to list Broening Oberg Woods & Wilson as one of its community partners and Capital sponsors.  Tyler is also passionate about cooking, film, the Phoenix Suns and University of Arizona basketball.

Representative Experience

  • In January 2020, Tyler and Bobby Sullivan won a $1.1 million award for the firm’s client, inclusive of damages, interest, attorneys’ fees and costs.  The lawsuit involved disputed commercial leases for construction equipment.  The firm’s client had alleged the defendant/lessor breached its contract and committed fraud by failing to pay rents and other charges owed under the lease, while the defendant/lessor contended its non-payment was consistent with the parties’ course of dealing and that payment had been waived.  This award is in addition to $450,000 the firm recovered for the client pre-trial.  This award followed Tyler successfully proving at evidentiary hearings the defendant was liable for Rule 37 discovery sanctions for suppressing evidence, and receiving a $20,000 discovery sanction in the client’s favor.
  • In April 2018, Tyler secured a dismissal for his legal malpractice client pursuant to Rule 37. Through digital forensic evidence, Tyler established that the plaintiff had suppressed and destroyed evidence before and during litigation. The Court imposed discovery sanctions against the plaintiff in the form of dismissal and a judgment in favor of Tyler’s client of approximately $200,000 for attorneys’ fees and costs.
  • In December 2017, Tyler defended a contract manufacturer who was sued for product liability a nutraceutical product sold nationwide. Plaintiff alleged the manufacturer had contaminated the product, and that these contaminants caused serious physical illness in thousands of customers nationwide. As lead defense counsel, Tyler obtained an order of Dismissal With Prejudice in Yavapai Superior Court, as well as an attorneys’ fees and costs award in excess of $60,000.00.
  • In February 2016, Tyler was lead defense counsel in an Arizona District Court lawsuit brought by an owner of a fleet of towing vehicles against its group auto insurer. Tyler led discussions among four insurers to negotiate the settlement of allegations regarding fraud, breach of contract and bad faith.
  • In January 2015, Tyler defended a large national insurance company in an Arizona District court lawsuit brought by a homeowners’ association. The homeowners’ association alleged the insurance company had breached its contract and committed bad faith in its adjustment and compensation of hail damage to the roofs of 20 buildings. Tyler prepared and prevailed on a Motion for Partial Summary Judgment. Tyler also was lead trial counsel and secured a defense verdict, resulting in an attorneys’ fees and costs award in favor of the insurance company in excess of $250,000.00.
